Bayer AG vs. Behn Meyer & Co.(M) SDN.BHD (Mesurol, BM Mesuron)- 2010-12-09 15:34:47The Commercial Court of Central Jakarta rejected a cancellation lawsuit filed by Bayer against Behn Meyer on November 10, 2010. Bayer alleged Behn Meyer on having a bad faith in registering trademark BM MESURON, for it is similar to MESUROL.
The judges consider that well-known reputation claimed by Bayer cannot be established because the evidences submitted by Bayer, being self-made notes that list countries in which trademark MESUROL has been registered, do not amount to prove its claim.
We have no further information on whether or not Bayer had filed cassation.
When filing cancellation, it is important to be well-prepared, not only the lawsuit, but also the evidences. Evidences need to be in original or at least their certified copies. Certificates or other documents issued or can be verified by a third party (such as government institution) are more reliable than self-made documents.
