THE DGIPO'S NEW POLICY REGARDING PAYMENT FOR THE LAPSED ANNUITY FEE

On 31 January 2019 the Directorate General of Intellectual Property (the DGIP) Office issued a Circular Letter regarding grace period for late payment of annuity fee. Patentee can still pay annuity 6 (six) months as from the lapsed deadline.


As regulated in Patent Law No. 13 year 2016, the deadlines to pay annuities are:


1. Article 126 paragraphs (1) of Patent Law No. 13 year 2016 "The payment of the first annual fee shall be made at the latest 6 (six) months as from the issue date of patent certificate"


2. Article 126 paragraphs (3) of Patent Law No. 13 year 2016 "The payment of the subsequent annual fees shall be made at the latest 1 (one) month before the same date as Filing Date of the protection period of the subsequent year"


If the 6 (six) months grace period is lapsed without payment, in conjunction with article 128 paragraph (1) of Patent Law No. 13 year 2016, the patent will be deemed cancelled.
