Jakarta, Indonesia – The PPH Program is a bilateral agreement to promote work sharing and enable patent applicants to request accelerated substantive examination in order to enjoy benefit of a faster grant decision, where patent examiners can make use of the work products between Patent Offices. In Indonesia, the PPH Program has been initiated between DGIP and Japan Patent Office (JPO) since June 1, 2013.

In early May 2018, the Indonesian DGIP Office issued a notice regarding updated requirements to participate in Patent Prosecution Highway (PPH).

In the said notice, the DGIP Office informs all Intellectual property consultants that when filing the PPH request, the following conditions should be met:

  1. The formality requirement has completed by attaching a notice of compliance.
  2. The substantive examination has been paid (attaching the examination request form).
  3. The publication period has expired (attaching a notice of publication).
  4. The first stage of substantive examination has not been started yet (No substantive examination report has been issued yet).
  5. Completed PPH request form.
  6. The requested claim has complied with the PPH requirement, i.e. the scope of claims is the same as or narrower than the scope of claims which have a positive result from JPO.
  7. Other requirements, i.e. examination result in first filed countries (member of PPH) which consist of OEE (office of earlier examination) as the first filed country, and OLE (Office of later examination) as a second designated country to accelerate its substantive examination.
  8. Translation of the OEE/OLE examination results in English and/or Indonesia.

Before the issuance of this notice, the procedure to file a PPH Program only require points 2 and 5-8 to be completed by the applicant. Therefore, this notice serves as a way to inform detailed requirements and updated procedures that have to be met in order to enjoy the benefit of PPH Program.

Furthermore, if all requirements have been completed by the applicant at the time of filing the PPH request, this notice also delivers the DGIP Office’s commitment to complete the examination of PPH application within 6 months from the PPH request date. 

It is still too early to see the impact of this updated requirements regarding PPH Program. However, the support and cooperation of all the related parties (such as IP Consultants, applicants, public, etc.) are essential for the success of implementation of PPH Program.
